How to Enter: NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. The Hard Rock Cafe Diet Pepsi "Academy Awards® Red Carpet Sweepstakes" ("Sweepstakes" or "Contest") begins at 10:00 a.m. Eastern Standard Time ("EST") on February 1, 2005 and ends at 10:00 a.m. EST on February 27, 2005 ("Sweepstakes Period").
Registration Form: To enter go to www.hardrock.com and click on Sweepstakes or go to www.hardrock.com/redcarpet to complete the registration form. Entrants must guess the winners of the 2005 Academy Awards® in following categories: Picture, Actor in a Leading Role, Actress in a Leading Role, Music - Original Song. Entrants correctly selecting the winner in all four categories (the "Eligible Entries") will be entered into the Grand Prize drawing. Winner will be selected in a random drawing from all Eligible Entries.
Sweepstakes is limited to one entry per person. Multiple entries by persons using different e-mail addresses are prohibited. Hard Rock Cafe International (USA), Inc. (a "Sponsor") will not verify receipt of entries. All entries submitted become the sole property of Sponsor and will not be returned. Odds of winning depend on the number of Eligible Entries submitted.
Winner Selection and Notification: On or about February 27, 2005, winner will be selected in a random drawing from among all Eligible Entries. Potential winner will be notified by phone or email. If potential winner cannot be reached within one (1) day (24 hours) from the first notification attempt, they shall be disqualified and an alternate winner will be selected. In the event of a dispute regarding the identity of the person submitting the electronic entry, the entrant will be deemed to be the person in whose name the email account is registered, provided that person meets all eligibility requirements. All decisions of the judges are final.
Eligibility: To enter the Sweepstakes you must be a legal United States resident, located and residing within the U.S. throughout the Sweepstakes Period and be 18 years of age or older. Sweepstakes is void in Rhode Island, Puerto Rico, overseas military installations and where restricted by law or where restricted in a manner not satisfied by the publication of these terms and conditions on this website. Employees of Hard Rock Cafe International (USA), Inc., and Pepsi-Cola Company (together, the "Sponsors"), their affiliated companies, parents, subsidiaries and advertising and promotion agencies, and each of their respective officers, directors, employees, representatives and agents (collectively, "Sweepstakes Entities"), and their immediate families and members of their households, are ineligible to participate in this Sweepstakes. No purchase is necessary to win. Purchase will not improve odds of winning.
Prize: One (1) Grand Prize trip for winner and travel guest consisting of: two (2) Red Carpet bleacher seats to the 78th Academy Awards® Red Carpet pre-show (to be held on or around February 2006, exact date TBD) in the Red-Carpet viewing area outside the Kodak Theater; round-trip coach air transportation for two (2) from the major gateway airport nearest winner's home to Los Angeles, CA (airports, itinerary and carrier selected at Sponsors' sole discretion); one (1) double-occupancy hotel room for three (3) nights (hotel selected at Sponsors' sole discretion); attendance at party to watch the 78th Academy Awards® broadcast at the Hard Rock Cafe Universal in Hollywood, CA following the Red Carpet pre-show; ground transfers to key events, and; $300 spending money. Approximate retail value up to $3,500, depending upon point of departure.
Red Carpet bleacher seats are non-transferable and have no retail or re-sale value. Prize does not include admittance to the 78th Academy Awards® ceremony in 2006, nor entrance into the Kodak Theatre. Winner and travel guest must comply with any security procedure or measures imposed by the Academy and/or its representatives and pass a background check. The Academy reserves its right in its sole discretion to suspend or cancel the participation of any winner or guest due to non-compliance with any security procedure or inappropriate behavior or misconduct. The 78th Academy Awards® Ceremony is subject to change and/or cancellation. Sponsors assume no responsibility for cancelled, delayed, suspended or rescheduled events or any other occurrence beyond its reasonable control. In the unlikely event that the 78th Academy Awards® Ceremony in 2006 is cancelled or altered in any way which would prevent or invalidate the awarding of reserved seating to view the red carpet festivities, the Sponsors are responsible only for providing the remaining portions of the prize as described above.
All other expenses not specifically mentioned herein (including, but not limited to, transportation between initial point of departure and airport, taxes, personal charges, meals, tips, and other incidental expenses) are solely the responsibility of the winner. Winner and travel guest must travel on same itinerary and must possess all necessary documents required for travel (e.g. valid photo identification). All travel must occur on the dates specified by Sponsors; no alternative travel dates and no travel extensions permitted. Unused travel will be forfeited. If travel guest is a minor under the age of 18, Winner must be minor's parent or legal guardian and must accompany minor at all times.
Prize cannot be used in conjunction with any other promotion or offer. Prize may not be assigned except by Sponsors in their sole discretion. Prize (or any component thereof) cannot be altered, transferred, substituted or redeemed for cash except at Sponsor's sole discretion, and then only for a prize of equal or greater value. Sponsors expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prizes awarded. Sponsors make no representations or warranties concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations apply. Sponsors will not replace any lost or stolen prize items. Travel must be completed on specific dates specified by the sponsor. If winner is unable to travel during the specified times, an alternate winner shall be selected. All meals, tips, insurance, taxes, and other expenses not specifically identified as included in the prize are the sole responsibility of the Grand Prize winner. Prize cannot be altered, transferred, substituted or redeemed for cash except at Sponsor's sole discretion, and then only for a prize of equal or greater value.

Prize Conditions: Potential prize winner will be required to execute an Affidavit of Eligibility and a Liability Release ("Affidavit/Release") and travel guest must execute a travel release. Such documents must be returned by the date and/or time indicated within such documents. If potential winner fails to return such documents within that time, or if an entrant is found to be ineligible, or if he/she does not comply with the Official Rules, then the potential winner will be disqualified and an alternate winner will be selected. If prize notification is returned as undeliverable, this will result in disqualification and an alternate winner will be selected. All federal, state or other tax liabilities (including income taxes) arising from this Sweepstakes will be the sole responsibility of the winner. Except where prohibited by law, the winner's entry and acceptance of the prize constitutes permission for Sponsors to use said winner's name, photograph, likeness, statements, biographical information, voice, and city and state address on a worldwide basis, and in all forms of media, in perpetuity, without further compensation.
Sweepstakes Conditions: This Sweepstakes is subject to all applicable federal, state and local laws. Sweepstakes also void where restricted in a manner not satisfied by the publication of these terms and conditions on this website. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsors and waive any right to claim any ambiguity in the Sweepstakes or these Official Rules. Winner and entrants also agree to release, discharge, indemnify and hold harmless Sweepstakes Entities from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or while preparing for, traveling to/from or participating in any Sweepstakes -related activity or participation in this Sweepstakes.
Limitations of Liability: Sweepstakes Entities are not responsible for lost, damaged, illegible, late, misdirected, undeliverable, destroyed or incomplete entries due to system errors or failures, or incorrect or inaccurate entry information whether caused by Web Site users or any equipment or programming associated with the Sweepstakes or any technical or human error in the processing of entries, or faulty transmissions or other telecommunications malfunctions and/or entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, or for any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or providers, computer equipment, or entries not received by Sponsors on account of technical problems or traffic congestion on computer networks, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from entering the Sweepstakes or downloading any material for the Sweepstakes, or other telecommunications malfunctions which may limit an entrant's ability to participate. Sponsors may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in their sole discretion, they determine that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsors representatives. If for any reason this Sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or any other causes beyond the reasonable control of Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then Sponsors reserve the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. If, in Sponsors' opinion, there is any suspected or actual evidence of tampering with any portion of the Sweepstakes, or if technical difficulties compromise any portion of the Sweepstakes or the integrity of the promotion, Sponsors reserve the right to suspend, modify or terminate the Sweepstakes and conduct drawings to award the Prize using all legitimate and eligible entries received as of the date of action taken by Sponsors.
By entering, entrants agree to release and hold harmless Academy of Motion Picture Arts and Sciences (A.M.P.A.S.) and their respective members, officers, attorneys, employees, and agents from any and all damage, injury, death, loss, costs or other liability of any kind, including attorney's fess, that may arise from or in connection with his or her entry, possession or use of any prize, or his or her participation in the promotion, or from any misuse or malfunction of any prize awarded.
