CAFES




1. How to Enter: NO PURCHASE NECESSARY. The Hard Rock Cafe Halloween in Hawaii Sweepstakes (“Sweepstakes”) begins at 3 pm (EST) on Friday, September 13, 2002 and ends at 10:00 a.m. (EST) on Monday, October 7, 2002 (“Sweepstakes Period”). To enter: 1: go to hardrock.com, click on the Halloween in Hawaii contest banner and fill out the registration form. All entries submitted become the sole property of Sponsors and will not be returned.

2. Eligibility: To enter the Sweepstakes you must be a legal resident of the United States and be 18 years of age or older. Sweepstakes is void in Rhode Island and Puerto Rico and where restricted or prohibited by law. You are not authorized to participate in the Sweepstakes if you are not located within the United States. Employees of Hard Rock Cafe International (USA), Inc., Pleasant Holidays, their affiliated companies, parents, subsidiaries and advertising and promotion agencies, and each of their respective officers, directors, employees, representatives and agents (collectively, “Sweepstakes Entities”), and their immediate families and members of their households, are ineligible to participate in this Sweepstakes.

3. Drawing and Notification: Winner will be selected from all eligible entries received in a random drawing held on or about October 7, 2002 by Hard Rock Cafe International (USA), Inc. Odds of winning depends on the number of eligible entries received. Potential winners will be notified by phone and/or e-mail. If a potential winner cannot be reached within two (2) days from the first notification attempt, then such person shall be disqualified and an alternate winner will be selected.

4. Prize: One (1) Grand Prize: trip for two to Maui. Trip consists of: Round-trip coach airfare for two people from major U.S. gateway airport nearest to Grand Prize winner's residence to Maui; 5 nights hotel accommodations at an Aston resort (double occupancy), daily car rental, plus $200 in vouchers for food and non-alcoholic beverages at the Maui Hard Rock Cafe (Approx. Retail Value $2,500.00). If the winner chooses to travel for Halloween 2002, travel must be completed on specific dates specified by the sponsor. If winner is unable to travel during the specified times for Halloween 2002, travel must be completed by October 31, 2003 and must be arranged at least 30 days in advance. Accommodations and air transportation are subject to availability and blackout periods may apply.. All meals, tips, insurance, taxes, and other expenses not specifically identified as included in the prize are the sole responsibility of the Grand Prize winner. Prize cannot be altered, transferred, substituted or redeemed for cash except at Sponsor’s sole discretion, and then only for a prize of equal or greater value.

5. Prize Conditions: Potential Grand Prize winners will be required to execute an Affidavit of Eligibility, a Liability Release and a Publicity Release (“Affidavit/Release”). Such documents must be returned by the date and/or time indicated within such documents. If potential winner fails to return such documents within that time, or if an entrant is found to be ineligible, or if he/she does not comply with the Official Rules, then the potential winner will be disqualified and an alternate winner will be selected. If prizes or prize notifications are returned as undeliverable, this will result in disqualification and an alternate winner will be selected. All federal, state or other tax liabilities (including income taxes) arising from this Sweepstakes will be the sole responsibility of each winner. Except where prohibited by law, the winner’s entry and acceptance of the prize constitutes permission for the Sweepstakes Entities to use said winner’s and his/her travel companions’ name, photograph, likeness, statements, biographical information, voice, and city and state address on a worldwide basis, and in all forms of media, in perpetuity, without further compensation.

6. Limitations of Liability: Sweepstakes Entity is not responsible for lost, late, misdirected, undeliverable or incomplete entries due to system errors or failures, or faulty transmissions or other telecommunications malfunctions and/or entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, or for any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or providers, computer equipment, or entries not received by Sponsor on account of technical problems or traffic congestion on computer networks, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from entering the Sweepstakes or downloading any material for the Sweepstakes, or other telecommunications malfunctions which may limit an entrant’s ability to participate. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. If for any reason this Sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

7.
